Over the last several months, the late night eatery, Victoria’s Cafe has had a rocky relationship with the City of Binghamton.
Friday a city judge ordered the establishment shut down.
The court ruled that the café violated an agreement with the city when the owner did not immediately let police inside after gun shots were reported in the area.
Back in December a city court judge said the café could stay open if there was no alcohol or criminal activity on the property and that police be allowed in at any time.
It’s just a fact of life that that is some of the worst element in the city of Binghamton go to that establishment once the legal bars close at 3 o’clock and they have to be empty by 3:30 a.m. There have been numerous shootings there, disturbances, said Binghamton Police Chief Joseph Zikuski.
The attorney representing the cafe’s owner says the city has unfairly targeted the café and does not feel the agreement was violated.
The defense says the fight to keep the café in the neighborhood is not over.
But for now it seems the after hours eatery has served its last meal.
The tenants who occupy the apartments in the building will receive a 30-day notice to vacate.
The defense says his next step will be to appeal the decision in county court.
