On Friday, the Broome County Grand Jury handed up a 47 count indictment against Charles Zimmer, Jr, 63, of Waverly, charging him with one count of Grand Larceny, two counts of Scheme to Defraud, thirty-eight counts of Offering a False Instrument for Filing, five counts of Failure to File Payroll Records under the Labor Law, and one count of Failure to Pay Prevailing Wages under the Labor Law.
The indictment alleges that from 2007 through 2008, while doing business as McCall Masonry and/or Brandy Masonry, Zimmer failed to file certified payroll records and/or filed certified payroll records containing false information with the NYS Department of Labor as required under the public works contracts in Broome, Tioga, Schuyler and Cayuga Counties
He is also accused of failing to pay prevailing wages as required under the public works contracts he held in Broome County.
The case was investigated by members of the NYS Department of Labor.
Assistant District Attorney Sandra Cardone is prosecuting the indictment.
