Kirkwood Woman Opts for New Trial Over Plea Bargain

A Kirkwood woman convicted in a 2009 home invasion and murder has opted for a new trial over a plea bargain.
In December of 2010, 25-year old Ashley Carnevale was found guilty of murder, attempted assault and robbery and sentenced to serve 15 years. The charges stemmed from a home invasion in Windsor in which she and her husband were alleged to have forced their way into a Windsor home to steal prescription drugs. The home’s owner was shot and injured and a friend of his was shot and killed in the incident.
Carnevale’s husband pled guilty to murder and attempted murder and is serving 25 years to life in prison. But last December, the New York Court of Appeals ordered a new trial for Ashley, because they ruled that her defense did not provide adequate representation. One point of contention were statements made following her arrest which the court said were made after a lengthy interrogation by police that the defense attorneys did not try to have thrown out.
On Thursday morning, Broome County prosecutors offered Carnevale a plea deal, but she rejected it and said she wanted the case to go to trial.
