Driver in fatal car crash in Elmira will not be charged

The driver who hit and elderly couple near the Clemens Center in Elmira last fall will not be facing charges.

The couple was crossing the Clemens Center Parkway when they were struck by a car on Nov. 20th.

Both victims were taken to a local hospital with serious injuries. 80-year-old Judith Morse from Horseheads passed away from her injuries.

The Chemung County District Attorney’s Office has announced the driver will not face charges because they could not stop in time and potentially did not see the couple.

The driver cooperated with the police investigation, and officials have called the incident a tragic accident.
