The lawyer for Cal Harris was in Albany Monday to appeal his client’s murder conviction.
William Easton asked a state appellate court to reverse his client’s conviction on second-degree murder charges and order a new trial or dismiss the murder indictment altogether based on a lack of evidence.
Tioga County District Attorney Gerald Keene argued why the conviction should be upheld on appeal.
Harris was convicted two years ago of killing his wife, Michele, in 2001. He is serving 25 years to life at a state prison in Auburn.
Harris was also found guilty of the crime in 2007, but that was thrown out by a judge and a new trial was ordered after a new witness came forward.
There is no timetable for the appellate court to rule on Monday’s arguments.
