New York State Police have a man in custody in the death of a Tioga County infant that happened Sunday. At 7:14 AM Tioga County 911 Dispatch received a call to check the welfare of an 8-month old girl who had gone missing from the Deep Well Motel on Route 17C in the Town of Tioga.
It was determined that the missing girl was last seen with her father, and at that point they began a search for 8-month-old Ruby Franciscovich.
Shortly before 8:00 AM Tioga Dispatch was contacted regarding a naked man on Route 17C just West of the Deep Well Motel. Troopers responded to that location and identified the naked man as Roby’s father, 25-year-old Cody Francisovich. When questioned about her whereabouts, Cody directed troopers to a pond in St. Patrick’s Cemetery about 2/10’s of a mile from the Deep Well. Troopers responded to the cemetery where they located Ruby’s body face down in the water, approximately 25-feet from shore. The responding officer waded into the pond, removed her from the water, initiated CPR. She was transported to Wilson Hospital where she was pronounced deceased.
State Police say the Franciscovich had been living at the Deep Well Motel for the last couple of months and are from the area.
Cody Francisovich was taken into custody by the New York State Police and has been charged with Murder in the 1st Degree a Class A felony. Francisovich has been remanded to the Tioga County Jail without bail and is awaiting further court action this week in the Town of Tioga Court. Police say Francisovich had no prior criminal history as an adult. The investigation is continuing. An autopsy was performed Monday morning at Lourdes Hospital. Results are pending.
