WAVERLY – The Waverly Police Department extradited a man who was previously accused of felony assault when an eight month old child was exposed to fentanyl at a home in Waverly.
Timothy Ronald Henry, 49, was extradited from the Bradford County Jail in Pennsylvania back to New York to be arraigned in the Waverly Justice Court. He has been charged with felony assault in the second degree, felony reckless endangerment in the second degree, and misdemeanor counts of endangering the welfare of a child and reckless endangerment.
Henry was arraigned without incident and bail was set at $25,000. He was remanded to the Tioga County Jail in Owego to await further legal action.
On October 13, 2023 at 9:32 a.m., the Waverly Police Department and Greater Valley EMS received a 911 call reporting an eight month old child was in severe respiratory distress at a Broad Street residence. Police and EMS responded to the location to find the infant not breathing. Officers on scene rendered medical care to the infant prior to EMS arrival.
EMS then transported the infant to the Robert Packer Hospital Emergency Room for medical attention. Further life savings measures were done.
The infant was life flown by helicopter to Geisinger Medical Center in Danville, Pa. for further critical medical care.
During the treatment and investigation into the incident the infant was found to have the drug fentanyl in her system.
Following further police investigation and with the assistance of the Tioga County, New York Child Protection Services and the Tioga County District Attorney’s Office criminal charges were filed by police.
A warrant of arrest was obtained for Henry, who is the paternal father of the infant. The infant has since recovered from the fentanyl overdose.
On December 19, 2023 at approximately 2:36 p.m., Waverly Police were advised by Sayre police that Henry was located and arrested without incident at a residence in Sayre. He was being held at the Bradford County Jail on $100,000 prior to his extradition to Tioga County.
