Pennsylvania vape product directory enforcement begins October 19

Pennsylvania Attorney General Dave Sunday says enforcement of the state’s new electronic nicotine delivery system directory law can begin Monday, October 19.

Act 57 prohibits the sale in Pennsylvania of nicotine-containing vape and e-cigarette products that do not appear on the state’s approved directory. The Office of Attorney General is responsible for building and publishing that list, along with compliance forms, information, and frequently asked questions for manufacturers, wholesalers, retailers, and consumers.

The attorney general’s office says the directory is intended to identify products whose manufacturer certifications have been submitted and approved. State guidance also explains that some certifications remain under review. A pending certification does not by itself establish that a product has been approved for retail sale.

Retailers and wholesalers should review their inventory and the current state directory before the enforcement date. The law gives the Pennsylvania Department of Revenue and Office of Attorney General authority to inspect businesses that sell or store nicotine-containing electronic cigarettes and to examine required records.

Sunday said the law is aimed at keeping harmful products away from children and adults who may not know what they are consuming. The office says it has worked since the law was signed to give businesses and consumers resources to prepare for compliance.
