A state appellate court has ordered a new trial for a man convicted of multiple drug charges in Broome County almost four years ago. On November 4, 2015, a jury convicted Thomas Newman of three counts of criminal possession of a controlled substance in the third degree, criminal possession of a controlled substance in the fourth degree and criminally using drug paraphernalia in the second degree. Month’s earlier Binghamton police officers executed a search warrant and allegedly discovered narcotics, cash and items associated with the sale of drugs in an apartment shared by Newman and his girlfriend. In a 11-page and detailed decision, the court found some flaws in the arrest and prosecution. In its ruling the court ordered that the judgment is reversed, on the law, and the matter remitted to the County Court of Broome County for a new trial.
