An Endicott man is facing felony charges after being caught in the act by the homeowner while he attempted his second burglary of the night in the Town of Union.
On Sunday, December 7, at approximately 5:00 p.m., Broome County Sheriff’s Road Patrol deputies responded to a 911 call reporting a burglary at a residence on North Street in the Town of Union. The caller had reported that someone had broken a window to their house and was trying to get inside before being confronted by the homeowner.
Upon arrival, responding deputies found the suspect, Nicholas J. Sacco, age 42 of Endicott, NY, lying on the ground in a fetal position while the homeowner stood nearby holding a snow shovel. After Sacco was taken into custody, the homeowner was treated at the scene by EMS for lacerations to his arm.
During the investigation, the homeowner reported hearing glass breaking near his residence shortly after arriving home from work at around 4:45 p.m.. After the initial noise, the homeowner reported hearing glass breaking again, but this time from the back of his own house, near his kitchen door. The homeowner stated that he discovered Sacco attempting to break in and confronted him, pushing him off his enclosed porch. Sacco then reportedly attempted to come back through the porch, at which point the homeowner grabbed a snow shovel and began striking Sacco multiple times. Sacco reportedly tried to flee, but the homeowner kept him near the scene until deputies arrived.
During the investigation, BCSO deputies also discovered that the property next door, a hair salon, was also burglarized.
Following a full investigation into both burglaries, Nicholas J. Sacco was charge with:
– Burglary in the 2nd Degree, a Class C Felony
– Burglary in the 3rd Degree, a Class D Felony
– Two (2) Counts of Criminal Mischief in the 3rd Degree, Class E Felonies
Sacco was arraigned at Central Arraignment Part and remanded to the Broome County Correctional Facility.
The Broome County Sheriff’s Office was assisted by the Union Volunteer Emergency Squad.
“A good lesson from this case is for would-be burglars to think twice before choosing to break into someone’s house,” said Sheriff Fred Akshar. “You may find a homeowner ready to defend their family and their property.”
