Trial for Cal Harris’ lawsuit against Tioga County officials, state police pushed back

The lawsuit filed in federal court by Cal Harris against Tioga County officials and state police has had its court date pushed back for a fourth time.

According to pressconnects.com, the lawsuit was originally filed in 2017 and was scheduled to go to court as early as Nov. 4 in Utica, but it has been pushed back to April after a request from the attorneys involved.

Since being scheduled to begin in June of last year, the trial has now been moved four times.

Harris was found not guilty of murder in 2016, ending a 15-year legal battle following the disappearance of his wife Michele Harris on Sept. 11, 2001.

Harris was tried four times in 11 years. He was convicted twice in Tioga County Court, but the first verdict was set aside when a new witness came forward and the second was eventually overturned on appeal.

A third trial was moved to Schoharie County, where the jury was deadlocked and a mistrial was granted. Finally, Harris chose a bench trial and was acquitted by a judge in 2016.

Harris has accused those involved in his criminal case with malicious prosecution and civil rights violations.

Defendants include former Tioga County District Attorney Gerald Keene and state police investigators Steven Andersen and Susan Mulvey.

The trail has been rescheduled to begin on April 28.
