A Sayre man has been found guilty of rape and child sexual assault following a trial in Bradford County Court.
According to the Bradford County District Attorney’s Office, 43-year-old Timothy Gainous was convicted of 51 total counts, including 10 counts of Felony 1 Rape of a Child, 10 counts of Felony 1 Involuntary Deviate Sexual Intercourse With a Child, 10 counts of Felony 1 Statutory Sexual Assault, 10 counts of Felony 2 Aggravated Indecent Assault of a Child, one count of Felony 3 Corruption of Minors, nine counts of Felony 3 Indecent Assault of a Child, and one count of Misdemeanor 1 Indecent Assault of a Child.
The victim, who is now 16 years of age, testified that when she was between the ages of six and nine, Gainous was her mother’s live-in boyfriend, and that he sexually abused her numerous times over a span of several years at their home in Athens Borough.
According to the District Attorney’s Office, as is common in many cases of sexual abuse of children, the victim did not report these offenses to authorities until years later. This was due in part to the victim’s fear of violent retribution, having personally witnessed acts of domestic violence by Gainous against her mother.
Gainous will be sentenced by Judge Evan S. Williams, III on May 14. The Rape and IDSI convictions are punishable by up to 40 years incarceration for each count. The Statutory Sexual Assault convictions are punishable by up to 20 years incarceration for each count. The Aggravated Indecent Assault convictions are punishable by up to 10 years incarceration for each count. The Corruption of Minors and Felony 3 Indecent Assault convictions are punishable by up to seven years incarceration for each count. The Misdemeanor 1 Indecent Assault conviction is punishable by up to five years incarceration. Gainous will be required to register as a sex offender for the rest of his life.
