A Binghamton man convicted of criminally negligent homicide has won his appeal, getting the verdict overturned. Jemark Ballenger was accused of causing a five car crash that killed a mother and daughter back in March 2009. Originally convicted in 2011 in Broome County Court, he had been sentenced to two to four years behind bars. But Thursday, the State Supreme Court Appellate Division ruled that the evidence against Ballenger did not prove direct involvement to the two victims’ deaths. As a result, the ruling has been dismissed.
