The State Supreme Court Appellate Division has rejected an appeal from an Elmira man who is serving a 12 year prison sentence. In 2016, a jury convicted now 46-year-old Jemar McCoy of several counts and levels of criminal possession of a weapon. McCoy was labeled a second violent felony offender and sentenced by a Chemung County Judge to three concurrent terms of 12 years in prison. Defense counsel filed numerous challenges to the conviction. In a detailed 8-page decision, the higher court rejected the appeal and ruled the sentence was too harsh. McCoy is at the Clinton Correctional facility and won’t be eligible for parole until 2026.
