A federal judge has thrown out a lawsuit that was filed against Gander Mountain by the husband of a woman killed in the shootings at the American Civic Association in 2009. Samir Muhammad Al-Salihi’s wife, Lyala Salman Khalil, was among the thirteen killed during the shooting. Al-Salihi filed a legal complain in April of 2011 alleging that the employees of Gander Mountain in Johnson City were negligent in selling semi-automatic pistols and ammunition to gunman Jiverly Wong. The lawsuit claimed that Wong exhibited signs of being mentally unstable when he purchased the weapons, and that Gander Mountain should have noticed and not risked allowing him to use the guns to harm himself or others. U.S. District Judge Norman Mordue dismissed the complaint in a 30-page decision which he issued on Friday, putting an end to the legal issue. Mordue stated that there was no evidence to suggest that Gander Mountain knew or should have known that Wong posed any risk of harm to himself or others. Wong killed thirteen people and himself when he opened fire at the immigrant center in Binghamton in April of 2009. The incident is one of the country’s most deadly mass shootings.
