Retired NYSP Investigator John Brenner took the stand yesterday at the Cal Harris murder trial. He worked as a DNA analyst for the NYSP for 25 years. Due to one of the jurors having food poisoning, Brenner’s testimony was cut short. His testimony will continue Monday morning in Schoharie County Court. Also yesterday, the defense requested another mistrial. Defense attorney Bruce Barket cited a note that came from one juror asking if the way Barket cross-examined was correct. Barket said the jury is picking up on the court’s attitude toward him and it will hinder Harris’ chance of a fair trial. Judge George Bartlett denied the request. It was the seventh mistrial request by the defense.
