New York Attorney General Eric Schneiderman announced an agreement between his office and five major retailers, following a criminal investigation which started in December of last year. According to Schneiderman’s office, Amazon, Walmart, ACTA, Sears and Kmart have all sold toy guns in violation of New York State and/or New York City laws. New York State law dictates that all toy guns must have a bright colored tip, as well as bright colored striping down the sides. New York City law is stricter with the entire toy gun needing to be brightly colored. Schneiderman says that these five retailers sold a total of 6,429 toy guns to New York residents that didn’t meet these standards. With the exception of some toy guns at Kmart, all of these sales were made online. Walmart is being required to pay $225,000 in fines, and the remaining four retailers will pay more than $84,000 in combined fines. Schneiderman’s investigation could have national implications for these companies, as seven other states have similar laws.
