Cal Harris lawsuit heading to trial in March

Cal Harris will be back in court in March.

Harris, who was tried four times over an 11-year period for the murder of his wife Michele, is suing a former Tioga County official and New York State Police Investigators under the Unjust Conviction and Imprisonment Act.

Harris originally filed the lawsuit in 2017, and it has been pushed back four times, but now it will finally head to court.

Harris was found not guilty of murder in 2016, ending a 15-year legal battle following the disappearance of his wife Michele on Sept. 11, 2001.

He was convicted twice in Tioga County Court, but the first verdict was set aside when a new witness came forward and the second was eventually overturned on appeal.

A third trial was moved to Schoharie County, where the jury was deadlocked and a mistrial was granted. Finally, Harris chose a bench trial and was acquitted by a judge in 2016.

Harris has accused those involved in his criminal case of malicious prosecution and civil rights violations.

Harris is seeking at least $3.5 million dollars in damages. The trial is set to begin on March 17.
