A recent appointment to the Tioga County Legislature has been overturned in a New York Supreme Courtroom. New York Supreme Court Justice Jeffrey Tait has ruled that it is unconstitutional for a county legislator to be appointed for the remainder of an entire term. Justice Tait’s ruling comes after Dennis Mullen of Waverly was appointed to represent Tioga County Legislative District Number Five. A vacancy in District Five was left as a result of the death of former legislator Ray Case in December of 2015. The county legislator position must now go on the ballot for the November general election.
