The New York State Supreme Court Appellate Division has overturned an Elmira man’s murder conviction.
The court reversed the second-degree murder conviction against Demetrius Mack, who was charged with stabbing Albert Sturgis at a bar in 2017.
Mack and Willie Jenkins were both charged with murder following the incident at Gush’s Thirsty Bear.
The court said the decision to overturn Mack’s conviction came after it determined that Mack had not been considered for a justification defense even though there was evidence available to conclude that his actions were justified.
Jenkins’ conviction in the case was overturned by the same court in 2022.
